busy highway. a camera capturing this very close call. good tuesday morning. we have a lot to sort through. a new bombshell in the growing scandal surrounding david petraeus, the man who replaced him as the top commander in afghanistan is now under investigation by the pentagon. >> general john allen is said to have sent thousands of inappropriate e-mails to jill kelly. she is the florida woman whose complaints to the fbi eventually led to petraeus' resignation. in a new twist to the david petraeus sex scandal, the pentagon says that the top commander in afghanistan, general john allen, is under investigation, for sending allegedly improper e-mails to jill kelly. kelly is the florida woman who triggered the investigation and ultimately forced petraeus to

resign. the pentagon is reviewing between 20,000 and 30,000 documents involved. allen, meanwhile, denies any wrongdoing and remains in his current position. late monday, agents spent nearly five hours at the home of petraeus' former mistress, paula broadwell, leaving early this morning with several boxes. this, after the fbi told abc news they discovered thousands of e-mails between broadwell and petraeus, detailing the affair. >> in his universe, this moral failing is unacceptable and renders him unworthy of continuing this position of responsibility for the nation. >> reporter: the affair came to light over the summer, as part of an fbi investigation that began after jill kelly received threatening e-mails she believed from broadwell. >> the fbi, that's an investigation. and they realized they had general petraeus caught up in some fashion. and that caused them to take it all the way through to see what they really had. >> reporter: officials say broadwell had classified

material on her computer, which is illegal. but the fbi does not believe any of it came from petraeus. no charges have been filed against her. controversy over how the investigation was conducted has engulfed washington. members of congress want to know why the fbi and the attorney general waited until this pt wednesday to notify the white house. justice officials maintain there was no politics involved. our reporter as you can imagine, have been working this story all night. we'll have a live update, coming right up. and a writer who helped paula broadwell on the petraeus biographer said he was dumbfounded when he found out. vernon locke, his wife called him the most clueless person in america for not expecting something was going on. looking back, he says there were some red flags. >> what was a question in my mind, quite frankly, was why general petraeus was granting

lowest that it's been in three years. that's because the housing market is improving. and low interest rates are making it easier to refinance. the effectiveness of a top flu treatment is now being questioned. a top british medical journal says there is no evidence showing that tamiflu really stops influenza. dozens of governments around the world stock tamiflu in case there's a global flu outbreak. the world health organization says it is convinced that tamiflu does work. but british researchers want to see more data. a new pepsi flavor in japan does diet soda one better. it contains dextrin that supposedly reduces fat in the body. pepsi has introduced flavors in japan like strawberry, salty watermelon and yogurt. >> salty watermelon?

inappropriate e-mails to jill kelly. >> kelly, she's the florida woman who triggered the investigation, which led petraeus to step down. >> we want to get more insight on this quickly-developing story from lama hasan. she is live in our london bureau this morning. lama, can you break down for us, exactly, how big is an investigation is this? >> reporter: well, good morning to you, rob. there are reportedly between 20,000 to 30,000 pages of e-mails and other documents from general allen's communications with jill kelly, between 2010 and 2012. and they're underreview. defense department officials will not say whether they are involved in sexual matters or whether they are thought to include unauthorized disclosures. it's not known whether david petraeus is mentioned in these e-mails. rob? >> lama, this is paula. david petraeus resigned. but general allen so far has denied wrongdoing.

he is staying on the job for now. why is that? >> reporter: that's right, paula. defense secretary panetta has allowed allen to stay on in afghanistan. officials are reviewing, whatever happens is a matter of military rule, not a violation of federal criminal law. general allen will remain in his job. but the defense secretary has asked for the general's pending nomination, as nato's top commander to europe will be delayed. rob and paula? >> thank you for sorting all of that out on this tuesday morning. thanks. a lot of layers to this story to say the least. what's making it newsworthy is what access did paula have to classified information? was national security ever at risk? that's why this is getting so much attention beyond the soap opera-like details of this. it's really the access issue and national security. >> layers, would be an understatement. >> lots of questions. another developing story overnight. the search is on for tech pioneer john mcafee, wanted for

questioning in a murder. mcafee, who gave his name to the famous anti-virus software, lives in the country of belize, where his neighbor has been found shot to death. police there called the 57-year-old a person of interest in the case. and a lot of people describe his recent behavior as eccentric. and the voice behind elmo for nearly 30 years has taken a leave of absence, amid allegations that he had a relationship with a 16-year-old boy. 52-year-old kevin clash has denied the charge. but he acknowledged having a relationship with the accuser, 24, as an adult. sesame workshop says an internal investigation found the allegation unsubstantiated. things will get back to normal for drivers in new jersey who faced gas rationing after superstorm sandy. lines were hours long after the storm, when some gas stations couldn't get fuel and others didn't have the power to pump it. the governor now says the
